These Terms of Service (“Terms”) govern your access to and use of the website at humblesite.com and the services provided by HumbleSite (“HumbleSite,” “we,” “us,” or “our”), including website design and hosting, our customer and team dashboards, and our scheduling and booking tools (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

HumbleSite designs, builds, and hosts websites for small businesses, and provides tools for scheduling meetings and managing customer relationships. Specific projects, deliverables, pricing, and timelines may be described in a separate proposal, order, or agreement, which — where it exists — supplements these Terms.

2. Accounts

Some features require an account. You are responsible for the information you provide, for keeping your login credentials secure, and for activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

  • Use the Services to violate any law or the rights of others;
  • Upload or transmit malicious code, or attempt to disrupt or gain unauthorized access to the Services or related systems;
  • Send unsolicited bulk or “cold” email through the Services, or use them to harass others;
  • Misrepresent your identity or affiliation, or reproduce, resell, or misuse the Services without authorization.

4. Scheduling and meetings

Our scheduling tools let people book meetings on a HumbleSite team member’s available times and generate calendar invites and video-meeting links. You are responsible for the accuracy of the information you submit when booking (such as your name and email) and for attending or canceling meetings you schedule. Video meetings may be hosted through a third-party service; your use of that service is subject to its own terms.

5. Fees and payment

Where the Services are provided for a fee, the applicable charges (for example, a one-time website fee and any recurring hosting fee) will be presented to you before you incur them or set out in a separate agreement. Fees are due as described at the time of purchase and, unless stated otherwise or required by law, are non-refundable. Recurring fees continue until canceled.

6. Intellectual property

The Services, including our software, designs, text, and branding, are owned by HumbleSite or our licensors and are protected by intellectual-property laws. Content and materials you provide to us remain yours; you grant us the rights needed to provide the Services (for example, to host and display your website). Rights to project deliverables are addressed in the applicable project agreement.

7. Third-party services

The Services may integrate with or link to third-party services (such as Google, payment processors, and video-meeting providers). We are not responsible for third-party services, and your use of them is governed by their terms and privacy policies.

8. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the fullest extent permitted by law, HumbleSite will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us for the Services in the twelve months before the claim, or one hundred U.S. dollars ($100) if you paid nothing.

10. Indemnification

You agree to indemnify and hold harmless HumbleSite from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or your violation of these Terms or the rights of others.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access to the Services if you violate these Terms or if we reasonably believe it is necessary to protect the Services or others. Provisions that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wisconsin, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
